ACT OF THE APOSTILLE


Similar to the notarial act by a Notary Public, an apostille is a certification of a legal document or vital record for legal use in a different country signed on to the Apostille Convention. The Apostille Convention was first signed on October 5, 1961, in The Hague, Netherlands. The Apostille Convention is also known by its main objective: Convention of 5 October 1961 Abolishing the Requirement of Legalization for Foreign Public Documents. This convention or treaty between nations helped cut the unnecessary red tape of re-certifying a certified document in another country.

Currently, there are 118 Contracting Parties to this convention of the Hague Conference on Private International Law. This international organization exists to build cooperation between nations by building a unification of commercial laws, civil procedures, and families and children's protection. The Apostille Convention allows a legal document such as a power of attorney, notarized in Florida, to be certified by the Secretary of State for Florida to be used in Brazil.
